Terms of Service
These Terms of Service ("Terms") govern your access to and use of theDawnly: Easy Fasting mobile application and any related services (together, the "App"), operated by Ksun Trading Technology Limited ("Ksun Trading Technology", "we", "us", or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. The Service
Dawnly: Easy Fasting is a fasting and habit-tracking application that helps you plan fasting windows, log fasting sessions, track progress and streaks, set reminders, and review personal statistics. The App is provided for general informational, wellness, and self-tracking purposes only.
Health disclaimer. Dawnly: Easy Fasting is not a medical device and does not provide medical advice, diagnosis, or treatment. The information and features in the App are for general wellness and informational purposes only and are not a substitute for professional medical advice. Fasting is not suitable for everyone — including, among others, people who are pregnant or breastfeeding, under 18, underweight, or living with diabetes, eating disorders, or other medical conditions. Always consult a qualified healthcare provider before starting any fasting program or making changes to your diet, and stop and seek medical attention if you feel unwell. You use the App and any fasting practice at your own risk.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the App. By using the App you represent and warrant that you meet this requirement and that the information you provide to us is accurate.
3. Subscriptions, Purchases, and Auto-Renewal
The App may offer optional in-app purchases and auto-renewing subscriptions that unlock premium features.
- Payment is charged to your Apple App Store account at confirmation of purchase.
- Subscriptions automatically renew at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period.
- You can manage or cancel subscriptions, and turn off auto-renewal, in your device's App Store account settings after purchase.
- Any unused portion of a free trial period, where offered, is forfeited when you purchase a subscription.
All purchases are processed by Apple and are subject to Apple's terms. Refunds are handled by Apple in accordance with the App Store's policies; we generally cannot issue refunds directly.
4. Acceptable Use
You agree not to:
- use the App for any unlawful purpose or in violation of these Terms;
- copy, modify, reverse engineer, decompile, or attempt to extract the source code of the App, except where permitted by law;
- interfere with, disrupt, or attempt to gain unauthorized access to the App, our servers, or related systems; or
- resell, sublicense, or commercially exploit the App without our prior written consent.
5. Intellectual Property
The App, including its software, design, logos, text, and graphics, is owned by Ksun Trading Technology Limited or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial use. Content you create within the App (such as your fasting logs) remains yours.
6. Third-Party Services
The App relies on third-party services — for example, cloud hosting, analytics and crash reporting, advertising networks, and Apple's App Store. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for the content or practices of third parties.
7. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that any data or statistics it presents are accurate or complete.
8. Limitation of Liability
To the maximum extent permitted by law, Ksun Trading Technology Limited and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of, or inability to use, the App. To the maximum extent permitted by law, our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the twelve months before the claim, or USD 50.
9. Termination
You may stop using the App at any time. We may suspend or terminate your access to the App if you violate these Terms or if we discontinue the App. Provisions that by their nature should survive termination — including ownership, disclaimers, and limitations of liability — will survive.
10. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide notice within the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict of laws rules. Any disputes arising from these Terms or the App will be subject to the jurisdiction of the courts of Hong Kong.
